Anti-lockdown campaigner Simon Dolan has written a piece for today’s Lockdown Sceptics about his #BackToSchool campaign. Whether it be the largest restriction on personal freedoms in a generation, or the ludicrous decision to mandate face masks, this Government has proven time and time again that it is not up to the job.

Entrepreneur Simon Dolan, whose interests span accountancy to motorsport, raised more than £200,000 via crowdfunding to seek a judicial review of the restrictions of movement imposed in England back in March to limit the spread of COVID-19.

Mr Dolan vowed to continue with the case as the lockdown was gradually eased ahead of his day in court last week.

Judgment was reserved until Monday.

June: Dolan explains his lockdown legal action

Mr Dolan had told Sky's Ian King Live programme at the time the legal action was launched in June that his aim was to have the rules declared illegal and to 'get Britain back and working'.

He wrote on his Crowdjustice page: 'We believe that the govt has acted illegally and disproportionately over the COVID -19 lockdown and we are taking action.

'By forcing people to stay at home, and forcing businesses to close, they are, we believe, in contravention of basic Human Rights offered under English Law, that of the right to enjoy your property peacefully.'

The businessman, who is worth £200m according to the Sunday Times Rich List, told his Twitter followers than an appeal was being considered in the wake of Monday's judgment.

In his ruling, Mr Justice Lewis said that the rules in force on 2 July - the day of the hearing in the case - 'did involve a restriction on the freedom of assembly and association'.

But he added: 'The context in which the restrictions were imposed, however, was of a global pandemic where a novel, highly infectious disease capable of causing death was spreading and was transmissible between humans. There was no known cure and no vaccine.

'There was a legal duty to review the restrictions periodically and to end the restrictions if they were no longer necessary to achieve the aim of reducing the spread and the incidence of coronavirus. The regulations would end after six months in any event.

'In those, possible unique, circumstances, there is no realistic prospect that a court would find that regulations adopted to reduce the opportunity for transmission by limiting contact between individuals was disproportionate.'

    From his court case.

    On a personal note I would like to thank each and every one of you for your good wishes, encouragement and of course donations to the case.

    We are still waiting for an exact figure from the Govt for their costs (yes we have to pay for their costs too believe it or not), however our legal fees in total were £684,535 which is broken down as: Alone in the dark the new nightmare download.

    Lawyers and Barristers fees £469,854
    Govt Costs £121,210
    VAT £93,470 (there is no VAT on Govt costs)

    Our donations to the CrowdJustice site were £427,037. From this CrowdJustice take 6% + VAT for their fee. The balance of £396,291 was transferred along the way to our solicitors client account and then used to pay the legal fees. We also received 2 large corporate donations totalling £65,000. The balance of the fees and costs remaining, which were £223,244, were paid by myself.

    Dear Supporter,

    This will be the final update on our case.

    Having explored all legal avenues, we have decided it is time to close the campaign.

    Our case, whilst ultimately unsuccessful, did see some wins along the way. The biggest of these was when we forced the Govt to publish all the Sage minutes which they had previously kept hidden. We also had the extraordinary announcement from the Govt that ‘they had never closed schools’. It was at this point I knew they would do whatever they could to evade responsibility.

    Whilst this particular case is now over, the fight continues on through our organisation Keep Britain Free (KBF). This exists to fight for our basic freedoms – our basic human rights. We have some announcements coming soon about some smaller cases we are working on and our plans for the future so do make sure you check in on the website.

    I did see something on FB when the integrity about SD was discussed commenting on him being a millionaire and his mask contract during the pandemic. I was somewhat surprised to see he lived in Spain. I think that the government may well have infiltrated some organisations , as undercover agents, we know they do this.
